End-User License Agreement

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Joey Games LLC ("Company") for the HexBench software ("Software"). The Software includes the HexBench Client and, when separately licensed, HexBench Host and the HexBench server (together, the "Host Component").

By downloading, installing, or using the Software, you agree to this Agreement.


1. Free Client License

The Company grants you a non-exclusive, non-transferable, worldwide license to:

  1. Install and use the HexBench Client on devices you own or control, without charge.
  2. Connect to compatible hosted games without purchasing a Host License.
  3. Use player, builder, co-GM, or GM capabilities when an authorized server grants them.
  4. Create User Content through the Client as described in Section 5.

The Client License does not include the right to run a HexBench server or obtain source code.

2. Host License

A valid purchased HexBench Alpha, Beta, or retail base license ("Host License") grants the license owner a non-exclusive, non-transferable, worldwide, perpetual right to:

  1. Install and use the Host Component on one active server device at a time.
  2. Run one accessible HexBench server for the owner's games and authorized participants.
  3. Host from a personal computer or infrastructure the owner controls or rents.

Alpha and Beta Host Licenses retain these hosting rights after later releases. Optional expansions do not grant a Host License by themselves unless the product is expressly sold as a bundle that includes one.

3. Host Activation and Transfer

The HexBench Client does not require a Host License. The Host Component requires license activation. A Host License may be active on one server device at a time.

  • Deactivating the current host permits an immediate transfer to another device.
  • If the current host device is lost, broken, or otherwise unavailable, the owner may request a recovery transfer after a 24-hour cooldown.
  • The Host Component may contact the Company's license service for activation, deactivation, transfer, and validation of the one-active-host limit.

4. Restrictions

Except where applicable law requires otherwise, you may NOT:

  1. Redistribute, sublicense, sell, rent, or transfer the Software or any license key.
  2. Run the Host Component without a valid Host License or on more active server devices than the number of Host Licenses you own.
  3. Circumvent, disable, or interfere with host activation, license validation, or server-enforced permissions.
  4. Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Software.
  5. Use the Software or knowledge derived from it to create a competing product or service.
  6. Remove or alter copyright, license, or proprietary notices.
  7. Offer commercial managed hosting of the Software without a separate written agreement from the Company.

5. User Content

Maps, tokens, scripts, plugins, themes, worlds, and other content you create ("User Content") remain yours. You may share, sell, or license your User Content, provided it does not include or redistribute proprietary HexBench code or assets and you have the rights required for any third-party material it contains.

6. Open Components

Components expressly identified as separately licensed are governed by their own licenses, not by the proprietary restrictions above. These may include:

  • The separately published HexBench Plugin SDK under the MIT License.
  • Separately published game-system plugin code under the MIT License.
  • Game mechanics and rules content under ORC, CC-BY-4.0, or CC-BY-SA-4.0.
  • Third-party libraries and assets identified in NOTICE files and the credits screen.

An open license for one component does not apply to the HexBench Client, Host Component, server, editor, renderer, or internal tools.

7. Ownership and Source Code

The proprietary Software and its source code are the intellectual property of Joey Games LLC. The Company retains all rights not expressly granted by this Agreement. Purchasing a Host License, Alpha or Beta access, a retail license, or an expansion does not grant source-code access.

The HexBench name, logo, and associated branding are proprietary to Joey Games LLC.

8. Updates and Expansions

A Host License includes updates to the licensed core Software made generally available to owners of that license. The Company may offer optional expansions separately. An expansion does not terminate or reduce an existing Host License.

9. Privacy and Connectivity

Player connections and campaign data are handled by the chosen host. The Company does not require a HexBench account for ordinary Client use. Host activation data is handled as described in the Privacy Policy.

10. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SOFTWARE. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE APPLICABLE HOST LICENSE OR EXPANSION.

12. Termination

This Agreement terminates automatically if you materially violate it. Upon termination, you must stop using and destroy copies of the proprietary Software. Separately licensed open components remain governed by their respective licenses.

13. Governing Law

This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the Software and supersedes prior software-license terms, except for a separate written agreement signed by the Company.
